HOW COOKING WITH PRESSURE WORKS

A pressure cooker is a lidded pot that, when sealed, uses steam pressure to cook foods at higher temperatures than can be achieved by boiling. These devices speed the cooking process, infuse foods with richer flavors, and lock in moisture. Due to these benefits, pressure cookers are very popular devices. However, because of the high temperatures and immense pressure, when a pressure cooker malfunctions, anyone in the vicinity of the pot can suffer serious injuries and devastating burns.

PRESSURE COOKER RECALLS

A recall on its own might not be the only way that someone is warned about serious issues. In fact, the process of recalling a product like this can take months and might only happen after many people come forward with complaints. In order to initiate a recall, the Consumer Product Safety Commission has to get permission from the manufacturer. The CPSC then must determine if there’s a substantial product hazard. Three factors are evaluated in that investigation process:

The severity of the risk, such as the number of injuries reported overall and the severity of those warnings

The number of defective products potentially involved

The type of defects, such as problems with warnings, instructions, or packaging

$56 million settlement for BioMet M2a 38 and M2a Magnum hip implant

$4.5 million awarded over the Wright Medical Technology over Profemur R hip implant

$500 million awarded to five plaintiffs over Johnson & Johnson and DePuy Pinnacle MoM hip implant

$4 billion settlement over Johnson & Johnson ASR hip implant

$1.43 billion settlement to patients with Rejuvenate and ABG II modular stems

$11 million awarded to women over Wright Medical metal-on-metal Conserve hip device

DISCHARGING STUDENT DEBT OBLIGATIONS

When a school loses accreditation or closes because it cannot meet federal requirements, students are often left paying student loan obligations for worthless degrees or for credits that they might not be able to transfer to a similar program at another college.

Under a certain type of loan forgiveness called Borrower Defense Repayment or just Borrower Defense, students whose school mislead them or engaged in misconduct or violated certain state laws may have their loans forgiven, and be released from any further payment obligations. Students who are in default and parents who took out a PLUS loan to help pay for their child’s education may also be eligible to have their school loans discharged.

YOU MIGHT BE ELIGIBLE FOR BORROWER DEFENSE EVEN IF YOUR SCHOOL DID NOT CLOSE

To be eligible, you must be able to prove your school violated state law through act or omission directly related to your student loan or the educational service the loan was provided for. If you are eligible for forgiveness, you may have your outstanding loan debt forgiven, and you may be reimbursed for the amounts you have paid on the loans already.

Students who took out private loans or received funds through programs such as the Federal Family Education Loan Program, or a Perkins loan are not eligible to have these debts forgiven through the Borrower Defense program. Instead, they must take legal action against the school and use their recovery to pay their debt

BAILEY, JAVINS & CARTER, L.C.

Our roots and our hearts are in West Virginia. We have practiced law here since 1970, meaning we know the laws and the courtrooms in which they are applied. But our knowledge runs much deeper than that. We know the people who live here and we understand the hard work they do. Attorneys at our law firm are from coal mining families and grew up seeing firsthand the toll this dangerous work can take. We are proud to serve as advocates for people who have suffered that toll, as well as anyone who has been hurt at work or due to an act of negligence.

COMMON PRESSURE COOKER INJURIES: BURNS

Never underestimate the potential injuries for burns linked to a defective kitchen appliance like these high-pressure cookers. These burns can be challenging to treat even when medical attention has been obtained immediately. Just a few seconds of exposure to steam or boiling liquids can cause a victim to suffer burns all over the head, face, neck, arms, and body. One of the only ways to effectively treat severe burns involves removing the burned skin from the body to mitigate infection and promote healing. Burn treatments are both time-intensive and very painful.

PRESSURE COOKER DEFECTS

A pressure cooker requires extra care when using, but many users end up victims of serious burns and impact injuries when the devices explode because of defects and design flaws. Some of the most common defects include:

Improper steam ventilation causing an explosion

Defective locking mechanisms that allow the lid to be removed before the pressure is released

Poor lid seals that allow dangerous high-temperature steam to leak

Defective safety pins that allow the lid to blow off

Defective release valves that don’t allow the steam to escape and reduce pressure

PRESSURE COOKER BRANDS SUBJECTED TO RECALLS

If you or someone you know has already been seriously injured or burned by a defective pressure cooker, you may be entitled to significant compensation for your injuries. Victims may also report the incidence to the government to help initiate a recall or warn others before they purchase a dangerous appliance.

Some of the brands included in past recalls include:

Manttra
